1. Introduction
These Terms & Conditions (“Terms”) govern your access to and use of QuizStacker.com, the QuizStacker membership, member portal, quiz builder, training guide, downloads, updates, support resources, and related services.
QuizStacker is operated by Hodgkinson Publishing Ltd, a company based in the United Kingdom (“QuizStacker”, “we”, “us”, or “our”). By purchasing, accessing, or using QuizStacker, you agree to these Terms.
The service is intended primarily for business, commercial, professional, entrepreneurial, educational, and organisational use. You confirm that you are at least 18 years old and authorised to act for any business or organisation you represent.

3. The Membership
QuizStacker provides paid member access to a proprietary offline-capable quiz builder, operator training, updates, documentation, and related resources. Features may be added, removed, renamed, replaced, restricted, or improved over time.
Membership does not guarantee that every specific feature, browser capability, hosting method, third-party service, or integration will remain available indefinitely.
4. Recurring Billing, Price, And Cancellation
QuizStacker is offered as a recurring monthly membership at the price displayed at checkout. Unless otherwise stated, the advertised membership price is US $10 per month.
By purchasing, you authorise recurring billing until you cancel. Billing dates, currency conversion, taxes, VAT, card fees, and payment processor charges may depend on your location and payment method.
Your monthly QuizStacker membership price will not be increased while you remain continuously subscribed on the same membership plan. If you cancel and later rejoin, the then-current price may apply.
You may cancel future renewals through the available account or billing controls, or by contacting the support desk. Cancellation stops future billing but does not normally refund amounts already charged or extend access beyond the paid membership period.
5. Immediate Digital Delivery And Refunds
QuizStacker provides immediate digital access to the member portal, builder, training, and downloadable resources. By completing your purchase, you request immediate digital delivery.
Except where required by law, payments already processed are non-refundable. Genuine duplicate payments may be reviewed and refunded after verification. Nothing in these Terms limits rights that cannot lawfully be excluded.
6. Account Registration And Security
You agree to provide accurate information, keep login details confidential, use a strong password, and notify us promptly of suspected unauthorised access. Unless your purchase expressly includes multiple users, access is for one authorised member account.
You must not share, sell, lease, sublicense, transfer, publish, or disclose your member login.
7. Licence To Use QuizStacker
Subject to payment and compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use QuizStacker for your own business or professional purposes.
You may create unlimited quiz projects and may host, distribute, sell, license, monetise, or otherwise commercially use the standalone quiz HTML files you lawfully create with the builder.
You do not acquire ownership of the QuizStacker builder, source code, proprietary logic, templates, documentation, branding, training, or member resources.
You must not:
- Resell, clone, publish, distribute, or sublicense the QuizStacker builder or member materials.
- Reverse engineer, decompile, scrape, extract, or attempt to discover proprietary code, logic, systems, or methods.
- Remove required QuizStacker branding from Standard-edition exports where that branding is built into the product.
- Use automated systems to extract, reproduce, or create a competing builder from our materials.
- Bypass paywalls, access controls, account restrictions, or security measures.
8. Acceptable Use
You must not use QuizStacker, the website, member portal, builder, or outputs to break the law, infringe rights, violate privacy or confidentiality, create deceptive or harmful content, distribute malware, facilitate fraud, impersonate others, submit data you are not authorised to process, or violate third-party platform terms.
You are responsible for the legality, accuracy, safety, and compliance of every quiz you create, publish, sell, or distribute.
If you enable participant name or email capture, form posting, autoresponder handoff, or tracking links, you are responsible for the privacy notice, consent wording, lawful basis, list management, unsubscribe process, data security, and compliance of the receiving service.
9. Your Content And Quiz Outputs
You retain ownership of your own lawful content, prompts, project information, uploaded assets, and exported quiz files, subject to third-party rights and the licence restrictions in these Terms.
QuizStacker does not normally store your editable Project JSON files or exported HTML quiz files. You are responsible for downloading, naming, backing up, securing, hosting, and maintaining your own files.
You are also responsible for the AI service you choose, the prompts or information you submit to it, and all outputs you import into QuizStacker.
10. Intellectual Property
All rights in QuizStacker.com, the builder, brand, code, design, documentation, training, templates, methods, workflows, copy, graphics, and proprietary materials belong to Hodgkinson Publishing Ltd or its licensors. All rights not expressly granted are reserved.
11. Third-Party Services
QuizStacker may depend on or link to third-party services including ProductDyno, payment processors, hosting providers, browsers, AI providers selected by members, and support systems. We are not responsible for third-party downtime, errors, policy changes, security incidents, pricing, restrictions, or discontinuation.
12. Availability, Updates, And Support
We aim to provide reasonable access but do not guarantee uninterrupted, error-free, secure, or permanent availability. We may update, modify, replace, restrict, or discontinue parts of the service for maintenance, security, legal, provider, technical, or business reasons.
All support requests should be submitted through the Support Desk. We do not guarantee a specific response time or personalised implementation service unless agreed in writing.
13. No Guaranteed Results
QuizStacker does not guarantee revenue, profit, leads, sales, completion rates, audience growth, client acquisition, productivity, or any other result. Your outcomes depend on your offer, audience, implementation, marketing, pricing, skill, timing, and many factors outside our control.
14. Disclaimers And Limitation Of Liability
The website, membership, builder, training, downloads, and related services are provided “as is” and “as available” to the fullest extent permitted by law.
Nothing in these Terms excludes liability that cannot lawfully be excluded. Subject to that, we will not be liable for indirect, incidental, special, consequential, punitive, or exemplary losses, loss of profits, revenue, data, business, goodwill, anticipated savings, or losses arising from quiz content, AI outputs, hosting, third-party services, or member implementation.
To the fullest extent permitted by law, our total aggregate liability relating to QuizStacker will not exceed the amount paid by you for the relevant membership during the twelve months before the event giving rise to the claim, or £100, whichever is greater.
15. Indemnity
You agree to indemnify and hold harmless Hodgkinson Publishing Ltd and its directors, officers, employees, contractors, agents, suppliers, licensors, and service providers from claims, losses, costs, and expenses arising from your breach of these Terms, misuse of QuizStacker, quiz content, AI inputs or outputs, infringement of third-party rights, unlawful marketing, or non-compliant distribution.
16. Suspension And Termination
We may suspend, restrict, or terminate access where we reasonably suspect payment failure, chargebacks, credential sharing, resale, copying, reverse engineering, unlawful use, abuse, fraud, security risk, or breach of these Terms.
Termination does not transfer ownership of QuizStacker or member resources to you. Exported quizzes already lawfully created and downloaded remain yours, subject to these Terms and applicable law.
17. Changes To These Terms
We may update these Terms from time to time. Updated Terms will be posted with a revised date. Continued use after an update means you accept the revised Terms.
18. Privacy
Your use of QuizStacker is also governed by our Privacy Policy and Disclaimer.
19. Governing Law And Jurisdiction
These Terms and any dispute arising from them are governed by the laws of England and Wales. Subject to mandatory law, the courts of England and Wales have exclusive jurisdiction.
20. General Provisions
You may not assign your rights without our written consent. If any provision is invalid, the remaining provisions continue. Failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, Disclaimer, checkout terms, and any expressly incorporated written terms, form the entire agreement.
